COOP & CONDO TRANSFERS, REFINANCING:

  • Represent sellers of cooperative and condominium apartments
  • Represent buyers of cooperative and condominium apartments (for personal use, pied a terre, adult children's use, or investment purchases)
  • Pre and post closing occupancy issues
  • Represent sponsor purchases and sales
  • Represent boards of directors and managing agents of coops and condos; serve as legal transfer agent and legal counsel to coops and condos
  • Represent and advise low and middle-income coops, HDFCs, and sellers and purchasers of units there
  • Handle refinancing, making certain that prior loans are properly terminated and discharged and that new rates & other items are accurately included and documented in new loan materials and documentation
  • Advise clients regarding paying off of current loans on their unit, or refinancing

COMMERCIAL LEASES:

  • Represent and advise store, retail, and other commercial tenants – cafes, restaurants, retailers, etc

  • Represent and advise office tenants – lawyers, accountants, publishers, therapists, doctors, dentists, etc
  • Represent Landlords, drafting and negotiating commercial leases (office or retail) and draft lease renewals, extensions or terminations with new or current tenants

MORE COMPLEX or COMPLICATED COOP/CONDO TRANSFER ISSUES:

  • Represent and advise on estate sales (and on out-of-state tax and other implications or requirements)
  • Represent transfers into (and out of) ownership held by living revocable trusts
  • Handle transfers and sales for individuals in divorce or separation proceedings, or already divorced or separated
  • Represent and advise parties on foreclosure, pre-foreclosure or loan default situations
  • Handle transfers involving bankruptcy for the seller, or transfers involving a seller with court judgments, liens, or federal or state taxes owed at time of contract or closing
  • Represent and advise parties in families, partnerships, or other joint arrangements

GENERAL & OTHER REAL ESTATE RELATED SERVICES:

  • Provide general contract review, advice, and consultation as well as negotiation and drafting
  • Provide assistance when last minute issues arise suddenly, the day before closing or at the closing itself
  • Provide incorporation services & miscellaneous other real estate counseling & assistance

TRAINING, SUPERVISION, CONSULTING & LEGAL UPDATE SERVICES:

  • Train and advise Brokerage staffs, Management departments, and Real Estate firms and law firm departments on current real estate laws, basics and beyond in handing challenging closings, contract and lease negotiations, brokerage issues, pre and post closing occupancies, conflicts of interest, ethics, and myriad other problems and issues that arise pre-closing and at closing itself, and how best to attempt to resolve these to conclude the transaction and deal properly and fairly
